I believe these 22 Hornet rifle were issued to Pilots during WW II. They were made by H&R. Marked US Air Force on the receiver. They came with a 13" barrel. Let's say I ran across one of these guns in pristine condition and I find out the gun is not registered as an SBR. Is there any recourse for registering now, or could I pin an extension on the barrel to make it legal length, or should I just pass on the $50.00 gun. Looking for a little help. Thanks in Advance!

Just my opinion, so hopefully more knowledgable people will comment but,---
I think pinning is no good.
I think silver soldering or welding would be OK.
Then I inagine you could file a form 1 to make a SBR.
But all this is just a guess.

OK, thank you. Sounds logical. Anyone know for sure?

I'll give you $100 for it.
That way you make $50.00 and I'll log it in as a post sample.
can't, you did not make it. Its just like finding a TSMG in a barn. you can't form 2 since you did not make it.

Arent the barrel's removable? i thought those screw in like an uzi barrel w/ a barrel nut?
Yeah I guess you'd have to deactivate it and then reactivate it ... sorta dumb to me.

You cant even take control of it legally. MAYBE ( just guessing) it might be on the C&R list or you might be abel to get it added. If it isnt registered and is supposed to be its a bad deal to have control of. SBRs are just like unregistered MGs, bad bad bad bad. This no differant then a $50 FA M11 with no papers, walk away.

As far as and having an SOT goes you cant not have control of any NFA item that is contraband in its current state. Your SOT does not allow you to handle Illegal firearms even if you intent to register them. Filing and F2 on soemthing you didnt make is a NO NO. Finding one of these without the barrel is alittle grayer, there is no "once a SBR always a SBR" ruling like there is with MGs.

Sorry man thats how the law looks at it, it all depends if there is a C&R expection for this thing.

While I am no expert, I don't think what you have written is at all accurate.
While the ATF has ruled-once a machine gun-always a machine gun, I have never heard of a ruling- once a short barreled rifle-always a short barred rifle.
There fore I still maintain that welding or brazing a barrel extension would comply with the law.
The fact that it is a C&R is irrelevant.

I think that's precisely what MrM4 just wrote - you and he are in agreement.

Except for the fact that a permanent barrel extension would make the M4 legal. I say it would be legal, M4 says it wouldn't be legal.
What do you say?

What I said is that it may not be legal to have control of prior to having the extention. You can not work on a gun you dont have control of and you legally cant control contraband.

The question is "Is the rifle with a orginal 13 inch barrel contraband?"

From the list of C&Rs:

SECTION IV: National Firearms Act Weapons Classified As Curios Or Relics Under 18 U.S.C. Chapter 44

The Bureau has determined that the following National Firearms Act weapons are curios or relics as defined in 27 CFR 178.11 because of their dates of manufacture. These National Firearms Act weapons, classified as curios or relics, are still subject to all the controls under the National Firearms Act. However, licensed collectors may acquire, hold, or dispose of them as curios or relics subject to the provisions of 18 U.S.C. Chapter 44 and 27 CFR Part 178. They are still "firearms" as defined in the National Firearms Act and 18 U.S.C. Chapter 44.

Harrington and Richardson (H&R) Handy guns, with shoulder stock, mfd. at Worcester, MA, having a smoothbore barrel less than 18 inches in length, or having a rifled barrel less than 16 inches in length
.

The gun is legal to own in its current condition like I said earlier:

Cool. Thank you to all. Seems like the best thing to do is apply for a C&R and that should take care of any legalities.

LOL. Hell I'd give $100.00 for it too!! It just so happens that the person that has the rifle is a long time friend. He knows what it's worth. Reason that it's so cheap to me, is that I sold him the gun 30 years ago for $25.00. We ran across it when I last visited him. The man's entitled to make a buck!! LOL!!

Hey, But I do have an RPB M11A1 in the NFA sale section for a steal of a price. </shamelessplug>
