ATF Field Office has nothing to do with making a firearm under the NFA guidelines.. You will do an ATF 5320.1 as directed, and submit it to NFA Branch of ATF in Martinsburg, WV.

Columbus is nothing but inspectors/law enforcement. You talking to the WRONG people.

Q: How can an individual legally acquire NFA firearms?
Basically, there are 2 ways that an individual (who is not prohibited by Federal, State, or local law from receiving or possessing firearms) may legally acquire NFA firearms:
1. By transfer after approval by ATF of a registered weapon from its lawful owner residing in the same State as the transferee.
2. By obtaining Prior approval from ATF to make NFA firearms.
[27 CFR 479.62-66 and 479.84-86]

Q: What is the tax on making an NFA firearm?
The tax is $200 for making any NFA firearm, including “any other weapon.”

In Regards to Ohio's laws....You may have some trouble there depending on which county or wtf ever their called in that state. Getting a LEO signoff seems to be an issue for some folks. A trust may be your only option.

im not that confused we are also a class 3 state, thefield office helps me find the paperwork, she is also helping me get my f.f.l. I know all about the tax stamp. im also fingerprinted , if the ffl packet goes through i can also sell class 3 firearms. so do i have to register the mac first as a sbr, then aquire the parts? i buy all the parts at the gunshow there just waiting for my money and a few more parts so they can tell me yes or no, im also getting a real feather at-9. i just want to make it look nice, i have the us machinegun m11 grip and i want my foregrip on it with a threaded barrell ive been to court 4 times over these firearms, its hard for police to keep up with the laws :) so can someone help me locate parts? i know what im doing i dont ned 5-10 years in jail lol\

@ Duke, it might be easier to get permission to smith and make.

I'd really like to see the Ohio law that you are referring to, I've never heard of such a thing. It almost seems to contradict federal law and the ATF policy that possession of all the parts for an SBR can be "constructive intent."

Also, a collapsing stock will not work on a closed bolt gun.

.....the courts released them so i have to be some right? they said i was good, nothing mounted and no post / pre ban hi cap loaded

Just *having* the vertical foregrip with the pistol can get you in trouble as has been mentioned, for "constructive possession" if you don't already have approval by the ATF NFA for the weapon as an SBR or AOW. See this case:

The key phrase in it, is "the pistol would have to be registered as a short-barreled rifle, PRIOR to purchasing or possessing the shoulder stock and/or vertical grip"

Registration MUST come first.

Get rid of the foregrip (send it to a far away friend or relative to hold for you?) and then you can put your long barrel on without registration anyway... you're just putting a longer barrel on a pistol. Then get your approval as an SBR or AOW (I'd go SBR... more flexible).

I bought it at an auction and the sheriff said i was good, just to never mount until tax stamp passes

First, local ATF Field Office is not the place that you deal with.

Fill out the ATF 5320.1 in duplicate as required, you aint getting LE signature from what I understand in Franklin County, so you going to do Trust if you desire to have SBR inside of Franklin Co.

Barrel,,,, buy a blank, and make friends witih somebody that has lathe.. M11 barrel nothing special to cut, I have had friend cut an Uzi SMG barrel to spin in M11-9 upper, and have cut a stainless barrel that was in my AR-15 9mm down to fit another M11 upper, it is special in that it is fatter inside the upper, and looks like Uzi front end at muzzle, and takes my Uzi can straight up. Look at Lage, I seem to think he offered a barrel with blank front, cut it the way you want.

I have a std 9mm reamer, that is how my stainless SMG barrel chambered, runs fine and brass normal for handloading again

If this is the advice you are receiving from the enforcement branch of the ATF, you are being set up for failure.

Step4: wait
Step 5: get stamp back and collect parts and build gun

You may need to add a step if you need Leo sign off, or read up on Nfa trusts.
Also try and listen to the guys on this board, they know what they are talking about.

ABSOLUTELY CORRECT!

Even having the parts around to make it into an SBR before you get get the stamp is considered "constructive assembly" and will get you a trip to club fed.

Also, don't forget to fill out and send what's essentially the citizenship statement, form 5330.20, with the 5320.1 form. Often overlooked and causes delays.

cover your ass!!! fill out a form 1, make some shit up like 7 inch barrel 15 inch overall length, just get your serial number in the NFRTR, than fuck with it, add whatever you want.

i form 1 SBR almost every handgun i have just so i can fuck with it like, putting on a forward grip off of my AR-15

im sure you can contact Mike at USMACHINEGUN and get whatever barrel length you want. if he cant thread it to what you want than send it to Mark at TROSUSA. if you Must have a cobray stamp im sure orion arms could engrave it on the barrel for you.

Form 1 SBR your gun THEN concern yourself with everything else, Cover your Ass First then worry about the other stuff.

i thought about the stock block adapter and try a slide out. does anyone knows who will make me a barrel like i need. and im prepared for the tax stamp, im trying to get my ffl's to, so im fingerprinted by the fbi atf attorney general and sherrifs, but still getting money to get er done. so i will just go to the atf on broad street here in columbus. here we are allowed to collect but not mount, then you tell em what you want to do show pics of parts then do tax stamp, ive been to court over this the law dont know the law here lol. i know im making a nfa but why pay if i cant get the barrel i need? waste of 250. i want to find the parts first, convert to a side cocker and a rail on top. what do you think ? where can i get the barrel and what kind of stock would you go for? cant register without no parts to get? right?

DO NOT BUY THE PARTS FIRST.

This is maybe the worst idea I have heard in a long while. Unless you have copious amounts of time and money, there are thousands of better options out there on which to spend your resources.
